According to a recent American Medical Association (AMA) survey of 50 states, some 18 states have serious medical malpractice liability insurance problems. The causes:
- The recent bull market is leading more insurers to under malpractice premiums, and lower returns on investments in the "weak" economy will add to deteriorating financial results;
- Lawsuits and the rising costs of defending malpractice cases, along with excessive jury awards;
- Increased Competition has impacted Insurers profitability as more medical malpractice insurers seeking revenue growth and the cash flow led to intense price competition and eventual deteriorating financial results; and
- Cost containment has led to less Physicians time per patient and contributed to medical errors and more lawsuits.
